Is the European small claims procedure open to me?
Six questions as a rule, seven at most, in your browser, without any artificial intelligence model. At the end, you write to me with your result already drafted.
A client established in another EU country is not paying an invoice of a few thousand euros. Ordinary proceedings would cost more than the claim; the European small claims procedure was designed for this case.
The test checks its conditions in plain words. It asks neither your name nor your client’s.
Step 1 of 6
What is your claim about?
The procedure covers civil and commercial claims. It excludes employment law, insolvency, succession, social security, arbitration and violations of privacy.
What the test answers
Whether the procedure is open to you
Subject matter, amount, countries of the parties: the European Regulation sets four conditions. The test goes through them and says which one is missing, if any.
Before which court, and in which language
As a rule, the court of your client’s country. The test flags the cases where another court may hear the claim, and what changes if your client is a private individual.
Faster routes
If your client does not dispute the claim, the European order for payment or, in Belgium, recovery by a bailiff are often faster.
What happens to your answers
Nothing leaves your browser
The decision tree runs on your device. Your answers reach the firm only if you send the contact form yourself.
No artificial intelligence model is involved
The questions and the outcomes are written in advance. The same answers give the same result, every time.
No names
The test asks neither your identity nor your client’s. The summary contains your answers only.
What it is not
The test gives a steer, it does not qualify anything. The competent court, the applicable law and the weight of your evidence depend on the actual contract and exchanges, and the test does not bind the firm.
